Child custody decisions are handled by the Albright factors that boil down to the best interest of the child. Moral fitness of the parent is one factor. The criminal aspect of adultery is a non starter. It is unenforceable.

You need to consult with an attorney that practices in Domestic relations to move forward with a divorce and custody action. Myself and many others on this site practice in that area
