If your father is neither a danger to himself or others and if he is capable of managing his own affairs, he can also give you power of attorney to retain an attorney for him. You will not be able to speak on his behalf in court if you are his guardian. You probably won't be able to speak for him if you merely have a power of attorney.

If you have been appointed by a court as your father's guardian or conservator, you can file such a claim. If not, you need to get a guardianship or conservatorship established so that your father can act legally through it.
