Rear ended at traffic stop while in job vehicle

A truck rear ended me at a busy traffic stop, also causing me to bounce off the truck in front of me. I was on the job driving a company vehicle, thus workers comp. kicks in. Went to hospital, followed up with regular doctor who put me in rehabilitation. However, workers comp. limits treatments. Not getting any better from whiplash. The vehicle at fault has insurance and they contacted me rather quickly asking if I was ready to settle. I declined as I am hurt and want to know to what extent. At this point I am tired, missing work and don't know which way to turn. The accident occured on Oct. 7, 2005. I'm not up to fighting with W/C or the insurance company and I don't have the funds to pursue any on-going medical care. Please advise.

The care providers may be willing to accept a letter of protection from an attorney guaranteeing that the proceeds of any settlement will first be used to pay the care providers chargses. The Worker Comp insurer can be forced to provide all medical care by petitioning the worker comp commission. It also has to pay you for lost wages up to the limits allowed by worker comp. However, it will probably be subrogated to your claim against the other driver to the extent it paid for your care and compensation.
