Legal Question in Real Estate Law in Mississippi

land ownership

my family is fighting over use of 3.5 acres of land owned by my deceased grandfather. It is my understanding the land belongs to all offsprings equally. One aunt built a home on the land, but now says because she pays all taxes, she has legal say. how can problems be solved. other persons have barns and horses on the land and not aunt denies them access. What is heir property, and can they divide up the land and get individual titles to their portion?

Re: land ownership

I assume there was no Will. The land would descend to your grandfather's spouse (generally) and to his children equally. Grandchildren take the place of their deceased parent.

In your case, you will need to have the court determine the heirs and partite (divide) the property among the heirs.
