Property Damage???

I was rear ended and had no insurance at the time of the accident. My vehicle was totalled. Can I claim any property damage and will my license be suspended if I do???

Per Miss. Code 63-15-11, it appears that you have twenty days after the Miss. Dept of Public Safety receives notice of the accident to submit proof of your financial responsibility, agreement to make payments, or proof of insurance. If you don't, it will determine the amount of security you will have to provide to prevent suspension of your license and it will give you an opportunity to persuade them that you would not be liable for the accident. If you fail to provide the security, prove you would not be liable or otherwise prove you have sufficient financial responsibility, your license will be suspended within 60 days.

The above is based on my reading of the Miss. Code. It would also be helpful for you to contact the Miss. Dept. of Safety directly and learn their interpretation of the procedures.
