Legal Question in Business Law in Missouri

I sell brand name stuff on ebay and got removed from ebay. A couple days later, i got a cease and desist letter. They said i sell their brand name stuff through Ioffer.com . IN FACT,i only sell on ebay. what can i do?

As a Franchise Attorney I can tell you the following. In order to sell "brand name stuff" you have to be an authorized distributor of the brands. Otherwise, you will be sued for trademark infringement, among other things, which includes attorneys fees and is not a pretty pricture. What to do? Apply to the various brands and see if they will give you legitimate product distribution rights. Consult with a good business or franchise attorney in your area for specific advice.
