3rd degree assualt in domestic violence

Only property damage was done. One broken window so why 3rd degree assualt. No one was hurt or even touched or even threatened in any physical way. Can plead guilty to propertry damage only and pay fines?? What would the fines be for property damage. First offense would there be a jail sentence?

You will need to look at the complaint or information that was filed. Usually it will state that you put the victim in fear of being assaulted. If that is the case, it won't matter if you only did property damage. If a reasonable person would have been afraid under those circumstances, you could be found guilty. You face up to a year in jail and a $5000 fine. Your attorney may be able to work out something with the p.a., depending on your criminal history background, especially as to prior domestic assault charges or reports by the police. Good luck.
