Legal Question in Criminal Law in Missouri

Felony Espungement

6 years ago I was arrested and pled guilty to posession of narcotics with the intent to distrubute in Missouri. I have since completed the conditions of my probation in Delaware, the judge in Missouri giving me permission to move. I have since cleaned up my act, am clean and sober and living a good life. Is it possible for me to wipe my record clean? I have nothing else on my police record.

Yes, you should be eligible for an expungement now. Contact an experienced criminal defense attorney in the area of the Missouri conviction. He or she will probably be able to handle it for you without your having to come back. If your conviction was in the Kansas City area, call me at 913-648-7070 or email me at [email protected]. Good luck.

I'm not aware of a Missouri statute that would allow you to expunge a felony conviction from your record unless you could show that it was a false arrest and then other criteria would have to be meet. See Missouri Revised Statutes 610.122

Missouri courts have limited authority to equitably expunge criminal records unless there was illegal prosecution, acquittal, or extraordinary circumstances. (Jones v. St. Louis County Pol. Dept, 133 S.W.3d 524 (2004))
