Legal Question in Criminal Law in Missouri

Our son is being accused of dealing drugs at school. They don't have any evidence, they found no drugs. All of the information came from other students. They suspended him for 10 days, we are waiting the results from the school district. The school police officer says that he can press criminal charges & wants our son to make a statement, before the school district has made the decision. What should we do? How do we find an attorney that deals with this situation?

You should be able to find many criminal depesne attorneys in your area. In the mean time, tell the school Officer that your Son is waiting to consult with an attorney before giving any statements. That is unless the school officer can get the prosecutor to give your Son use immunity.

I handle juvenile and drug issues. I would not advise your son to make any statement until I have had a chance to review the evidence and talk with the persons involved. Although the Supreme Court has held that school authorities have wide leeway in dealing with security issues, that does not mean that they can abrogate your child's rights under MO juvenile law not to incriminate himself. Feel free to email me if you want to discuss this further.
