Gender Discrimination

I was told that my postion with company A was iluminated due to the department financial losses and therefore the department was closing. I the only female in the department and the lowest paid person. The two other males one a manager and the other male were told they are going to try to make a final go of this department and if this dosen't work out they would find them another postion in the company. I wasn't not given that option. Do I have any grounds for a lawsuit based on gender discrimination? if so on what grounds? This company has never promoted a women to a manager's level. The company has fired 4 women in the past month but no men of equal jobs or above jobs have been fired.

Your question as to whether you have grounds for a lawsuit cannot be answered definatively based only on the information you have provided. However, based upon the information you did provide, I do not see anything that would prevent your making a claim, if you do so timely.

I suggest that you spend teh time and or money to discuss your situation personally with an attorney in your neighborhood who takes employment discrimination cases. These types of cases are very dependent upon the whole combination of facts, so a clear answer based upon short emails, may not be possible.

It definitely smells like you have something here.

Go see a local employment rights lawyer to see what your options are. File your EEOC claim, but try to see your lawyer first, so you can craft a good complaint that points the EEO in the right direction on the off chance they actually investigate.

If you're still working, start creating your documentation file, get names and addresses (DISCREETLY) of witnesses everyone concerned, copies of papers that relate to your claim, get your employment file (they have to give it to you, and you don't have to tell them why you want it), and find out the names, etc of especially the women who have been fired.

Then, as is the norm, they will issue you a "Right to Sue" letter and, come hell or high water, get yourself into federal court WELL before the 90 days expires.
