Legal Question in Family Law in Missouri

My ex and I have joint legal custody using fathers address. He broke up with his girlfriend and we are currently living under the same roof in Illinois. I want to move back to Indiana where I'm from. I have a better job opportunity there as well. Once there I want to.modify custody and get physical custody. By moving and leaving kids here with their dad hurt my case?

I am not licensed to practice in Indiana. But, generally, if the kids aren't residing in the jurisdiction, a judge there has not authority to issue an Order affecting their custody. You may be able to seek a Modification of the Missouri Custody Order, in that Missouri Court after you move and get a job in Indiana. The facts of why you moved without the kids, could work for or against your getting sole or primary Custody. Before you move, you should consult directly with an attorney licensed to practice law in the State where the Custody Order was issued. Too little information is provided here to give you specific advice about your proposed plan. You need advice form an attorney that has access to more of the particular facts.
