Legal Question in Family Law in Missouri

Hello, I was looking for a lawyer to ask a question regarding a family member.My cousin is 16 and she was wanting to marry a 23 year old in Missouri, with parental consent. Is this legal? Would he go to jail for rape? I'm concerned for her and didn't want to go through a hassle of hiring a lawyer for one question. Thank you very much if you can help by answering my question.

A 16 year old can get a marriage license at 16 with parental consent. As for a rape charge, the law is in a unsteady period. It used to be that a man could not be convicted of raping his wife. That has changed. Normally once married, you're contacting nsidered emancipated. But, it is conceivable that a Prosecutor might try to add an underage (or statutory) charge to a rape accusation. But, the parental consent to marry, historically included consent to have sex with the spouse.
