My step-dad has to pay a large amount of money for back child support. The child in question lived with my step-dad for several of the years he now has to pay for. He has school records that show the child lived with him. The mother of the child claimed him when filing her taxes. Even with the school records to show the child did not live with the mother my step-dad has to pay for all of the years requested unless the child who is an adult now will sign a statement saying he lived with his dad. He refuses to do this and my step-dad now faces a felony charge for back taxes. Why are the school records enough to prove the child lived with his father?

As long as the custody support order is in effect, the payor owes the money. Quite often the child lives with the payer for part or all of the time. Your step father should consult w with the mother as she may have violated federal law for stating that the child lived with her or was supported by her for the time he was with his Dad.
