Legal Question in Civil Litigation in Missouri

My car was damaged by a hit and run driver. The driver was found but had no insurance. He came to me and the police before court and stated that he wanted to pay for the damages but was informed to wait until court to do so. He has since passed, before we could go to court. Is there anything that I can do to collect the money that he owes me?

Based upon the facts you described, you may be able to make a claim against the other driver's probate estate, on behalf of your Son. But, your insurer should pay for your Son's injury. The insurer would then have the claim against the decedent.

You must file a claim against his estate as well as a lawsuit against him and his estate. You must examine your policy to see what it pays in the case of ab uninsured individual hitting you.
