Legal Question in Civil Litigation in Missouri

If you file for Declaratory Judgment and you ask for damages on the Declaratory claim, do you have to file two separate claims? If so is the following in the correct order?

1. Declaratory Judgment Petition - Filed first

2. Tort Petition - Filed after Declaratory Judgment has been Ordered

I believe they should be filed together because there may be Statute of Limitations issues.
