Unless your present lease allows for a grace period, if rent is due on the first, the landlord can sue on the second, if rent has not been paid. If the tenant pays up (and the landlord accepts the late payment) after suit is filled, but before the tenant gets served, before getting served, the landlord usually can't get a money judgment. For that reason, most landlords wait longer to file suit. Read your current lease agreement, and pay your rent on time, if not a day before it is due.

If your landlord has, or you think is about to sue you, consult directly with a civil practice attorney in your area as soon as you can.

Good luck
