Legal Question in Legal Ethics in Missouri

If a student admits to having a drug problem to a school counselor, and although the counselor is not a qualified addictions specialist he attempts to counsel the student personally without referring to an addictions professional or treatment facility, and the student subsequently overdoses and dies, is the counselor and school liable?

Based upon the facts you described, there may be some liability. There isn't enough facts to assess the likelihood of successful suit by a family member of the student. If you're a family member, you should consult directly with a civil practice attorney, in your area.
