Legal Question in Personal Injury in Missouri

Auto accident

I was involved in an accident 7/27/03, I am 7 months pregnant. The car that we were in was ours that we just bought and the brakes were bad. We couldnt stop in time to avoid hitting the guy in front of us that had stopped unexpectdly due to supposed car trouble. He had no hazard lights or brake lights or signals so we had no warning.

We were all taken to the hospital as I was having contractions. We have liabilty and the other guy wont give us his insuarance info.

Re: Auto accident

If you were injured enough that an ambulance transported you to a hospital, then I feel nearly certain that a police reprot of some kind was made, describing all the persons involved, and there insurance information. As this collision happened just few days ago, the report may not be available to you for a week or more. If it was a local policeman that came to teh scene, then go to that municipality and request acopy of the accident report. If it was sheriffs deputy, call teh County and see where to get a copy of teh reprort, and how soon it might be available. If it wa sahighway patrollman, then call the highway patrol, to see where the report was filed.

Unfortunately, under the facts that you described, it sounds like the driver of yoru car is more likely to be responsible for the damage and injury in the car ahead of you, then the opposite. Look to see if anyone was given a ticket, and what the reproting officer thought was the likely cause of the collision. He wasn't there, so he doesn't have th final say, but the officer's assessment after tallking with the participants and inspecting the scene does carry some weight.

Good Luck,

Tony Smith
