Legal Question in Personal Injury in Missouri

need help car accident law suit

My daughter, Rachel, in Texas was summoned to appear in court in St. Louis on Feb. 11th. This is Progressive insurance company trying to recover money they paid out after an accident my daughter was in 6 years ago. Somehow her insurance had lapsed, and the wreck was her fault. We have no idea how much they are trying to recover, but it was a bad wreck, so I expect it to be substantial. She has no assets or money for a lawyer, or anything else. She doesn�t make that much at her job. She barely gets by. She really can�t even take off from her job for this court date. I do not have funds available at the moment to help her. What can she do? Is it past the statute of limitations?

It may be past teh statute date, but without more information, I don't know. The case would have to have been filed within five years of the accident. If it was not, then there may be a valid statute defense. If it was filed within the five year statute, then any defense would have to come from the facts. Your daughter needs a lawyer. If a judgment is rendered against her, she will likely have no choice but to take bankruptcy.
