Legal Question in Personal Injury in Missouri

im being sued in mo, court papers was filed but they have not served me, its been 3 years, the person that caused the acccident is trying to blaim me also and their issurance company has settled, i was told about this by a friend yesterday, how long does the other party have before the time is up, casenet says dismissed on me w/o prejudice, but dismissed with prejudice on him

Generally, a plaintiff has five years from teh date of the incident to bring an action for a tort (i.e. neglicence, assault, etc.) Some torts have shorter periods of limitation. Some factors can extend or restart the clock on tort actions. You should probably consult directly with a civil practice attorney in your area. Many offer a free or low cost initial consultation.
