Legal Question in Real Estate Law in Missouri

I own a house with my ex boyfriend. He and I are both on the mortgage, and both on the title. We purchased the house in September of 2011. The relationship fell through and I left September of 2012. He has lived there since then, and paid all the bills there. Since January of 2014, he has only made the mortgage on time twice. He is currently behind two (almost 3) months. I have offered to move into the house and pay the bills. He won't give me an answer if he wants me to do that or not. Is there anyway I could kick him out and me and my husband move in and take over? We don't have the money or credit to refinance so that's not an option. I don't want to be paying on a house I'm not living in and he refuses to let me live there. My husband and I plan to fork all of the cost to redo it and sell it ourselves (ex has tried selling on own and that's clearly not working at all). Help!!!

Based upon the facts you described, one if you needs to buy the other out, or you need to rent it to a third party. Recently your ex has been renting it ( his tent payment was your half of the mortgage payment) if you and your husband move in, yiur r we nt would be paying t your ex's half of the mortgage payment. You say that t your ex is behind on the rent. You are still responsible for half the maintenance and improvement costs. You may need to sue your to force him to make the property profitable ( get rent cover costs, etc.) This may spur him to make a deal with you.

Good luck
