Legal Question in Real Estate Law in Missouri

My younger brother was listed on the deed to my parents house along with my older brother and sister as well as myself. He passed away a few years ago and we need to have his name taken off the deed. Will this be difficult? I do not think he left a will.

It depends how he was listed and what interest he held. One way his interest evaporated at this death, while the other would require some action. If one of your parents is still alive, they may be able to execute a new deed. If both are deceased, (and your brother survived one of them) you will probably have to put the property through the probate court. Your short description leave too many variables to give you a simple answer as to how best clear the title to the property. I suggest that you consult directly with a probate or real estate practice attorney in your area. You need specific advice based upon kn owledge of the particular facts of this deed.
