Anytime a person operates a motor vehicle in a public roadway, they are liable for the damages suffered due to their negligence, recklessness, or deliberate acts. In the case of someone driving fit work, their employer can also be liable to the injured party. You did not provide enough information to determine if the grader operator is liable in your particular situation. You should consult directly with a civil practice attorney, in your area, to get specufic advice.
