Legal Question in Wills and Trusts in Missouri

I live in Missouri and have downloaded a durable power of atty. Does it have to be notorized in the hospital where my relative is incoherent?

Thanks,

Claude

She was hit by a car while walking in a parking lot. We are her only relatives and the hospital bills are piling up. Somehow we need to be able to defend her rights.

If your relative does not have capacity she cannot make a poa. . You may have to apply to be her guardian and conservator. A probate attorney on your area would be able to explain it.

Good luck

If she is incoherent, she is not competent to sign it with or without a notary.

You probably need to have the probate court appoint you as her guardian.

You could pursue the personal injury case on her behalf to pay the bills .

I'd be happy to offer a free consultation at my office.

Thanks.
