Legal Question in Workers Comp in Missouri

Job injury

I have a upper back/shoulder injury and have had surgery on the shoulder and still in theropy but the back still hasn't been taken care of if the doctor concludes nothing else can be done will I automatically receive a settlement or am I entitled to one?

You should consult an experienced workers' compensation attorney to see if a second opinion is warranted for your medical condition. If you have permanent impairment, you should be entitled to compensation. The employer and insurance company do not have to voluntarily provide that. When the doctors have issued final reports, a workers compensation lawyer can calculate what your claim is worth.

You only have a limited time in which to make your claim for compensation. It mar already be to late. Do not hesitate in contacting an attorney directly. The previous responses were both good. There is no doubt that you should consult with an attorney in your geographical area who handles such cases. If you are in the eastern part of the state, I can refer you to one of the very best. The initial consultation will be free of charge, and if the attorney determines that he can help you, i.e. get you a better settlement even after the attorney's fees are paid from the settlement than you can get yourself, then the attorney will take the case on a contingent fee basis, and you will not have to pay anything out of pocket.
