Legal Question in Workers Comp in Missouri

Statute of Limitations

What is the statute of limitations for filing for compensation for wages lost in a workman's comp case due to an accident at work? The accidednt occurred on 6/15/2006. The insurance companies have been putting us off for several months now. The ratings appointment was on October 23, 2006 and when we call to get results, we are just told that these things take time and they'll get back to us. What can I do?

Re: Statute of Limitations

A Missouri workers' compensation claim must be filed with the Division within two years after the date of injury or death, or after the last payment made on account of the injury or death, except that if the report of the injury or the death is not filed by the employer as required by statute, the claim for compensation may be filed within three years after the date of injury, death, or last payment made. As always, you should consult an experienced workers compensation attorney.
