Legal Question in DUI Law in Montana

traveling rights

If you get charged with a DUI, and you are going on a vacation with family for a week or so, can you travel out of state? What if it is an important holiday or a grand parent is sick? Can you travel if you have gone to court and you are found guilty? What if you haven't gone to court yet, therefore you are still innocent? Thank you, Sara

Simply "being charged with a DUI" does not by itself limit your ability to travel in any way. However, there are several circumstances where your ability to drive or travel may be impeded. If you "refused" to submit either a blood or breath test, then your driver's license may be suspended. Also, after appearing in court, the judge may place travel restrictions upon you as a condition of release pending trial. If you have been found guilty of DUI there may also be an additional suspension of driving privileges.

Please contact your attorney, and he or she can tell you whether or not there are any travel restrictions, and if there are to have them modified or obtain a travel permit for you to go on your trip or for your family emergency.
