Legal Question in Credit and Debt Law in Montana

co-signers being responsible for a loan

I had a co-signer on a loan for a vehicle, and I was unable to make payments on the loan. The co-signers, of their own will, have made the payments on the loan, and also repossesed the vehicle when I was unable to make payments. Do they have a right to sue me for the money they have paid into the loan? Even if they have paid the money up to this point with no questions asked?

Re: co-signers being responsible for a loan

Yes. They can sue you for indemnity. Had you performed, they would not have been required to perform under the contract, so they can get the money they paid back under the doctrine of indemnity.
