Legal Question in Credit and Debt Law in Montana

Medical bill debt on daughter incurred by her mother

My ex-wife took my daughter to a chiropractor after an auto accident from 12/01-5/02 and turned into her auto insurance which they denied. I was required by law to have medical insurance on my daughter which I did. A year and a half later ex-wife wants to know if these medical bills can be submitted. I asked and they said 1 yr from date of service. Meanwhile I received in the mail a letter from a collection agency for the entire debt of the bill. Each year I provided my daughter and her mom her new insurance cards and my daughter did take advantage of the medical services provided. I did not find out until 1 years later that there was a debt incurred by ex-wife. Medical insurance was provided for my daughter by me and her mom did not submit those bills to the insurance company or contact me until 10/3/03 to say there was a debt in my name and it was going to the collection agency. Not once did I ever receive a statement/invoice from the Chiropractic Clinic. What are my options?

Re: Medical bill debt on daughter incurred by her mother

You are liable for medical services provided to your daughter. Depending on the wording in your parenting plan, your ex more than likely has an obligation to share treatment information with you. Pay the bill and go after your ex for reimbursement.
