Legal Question in Traffic Law in Montana

Montana Traffic Law Pertaining to Ticketing

Is it lawful for an officer to send me a ticket several days after an accident? I assume the officer didn't fill his quota for the month, and so he mailed me an extra ticket after the accident, I was presented with one ticket at the time of the accident, and they sent me another one later (coincidently at the end of the month.) I'm not sure if this is legal or not. Please inform me either way. I am going to court sometime this week, and I would like to find out from you if I can contest it or not.

Re: Montana Traffic Law Pertaining to Ticketing

Sometimes upon review of his notes and/or police report an officer decides additional charges are warranted. In such circumstances it is not unusual for him to take the action you describe.

You are always entitled to contest any charges, and should do so if you feel you are not guilty of them.

The mailing procedure, however, is not legally objectionable.
