Legal Question in Wills and Trusts in Montana

Mothers Will left all to brother in prison

My Mother died last year. She owns land in several states. Will leaves it all to brother who is in prison. Mother was likely drunk when will was drawn up. Indian court in MT is handling case(poorly, just received copy of the will yesterday). There are other siblings plus my father. What are my options for a fair distribution or to simply protect our land from the many people who want it including the government for pennys on the dollar? Power of Attorney over brother in prison? If I am not involved can others prey on my brother and take the land? Are there simple things I can do from Georgia without the need to go to Montana or hire a MT lawyer to deal with the tribe? Is the fact that the Will names my brother benifactor solid enough that there are no worries about others taking it away? Your advice would be appreciated.

Re: Mothers Will left all to brother in prison

If your mother died in MT and that is where the will is being probated, there is nothing you can do in GA. You might repost your question and state that the matter relates to MT law.
