Legal Question in Credit and Debt Law in Nebraska

Debt settlement

I am looking in to debt settlement and I want to know if I need to worry about my house. My name is not on the loans but it is on the deed. We have only had the house for a few years, so there is not a lot of equity. Could the credit card companies come after my house?

Re: Debt settlement

Your property interest in the house is defined by the deed, not the loan. And yes, if a credit card company sues you and gets a judgment against you, it can put a lien against your interest in the house. Whenever the house is sold, superior lien holders (like your mortgage company) would get paid first, the other property owner(s) would get their percentage of the remaining money, and your credit card company would get your share of the property up to the amount of the judgment.

Be really careful with debt consolidation. There are some good companies out there, and some not so good. Make sure you understand how your creditors are going to get paid, and how much you are paying the debt consolidation agency. Your creditors have every right to pursue you personally even if you are in a debt consolidation program if they are not happy with the amount they are getting.
