My husband was sentenced 12 months ''flat time'' in the clark county detention center in NV, and is currently incarcerated. In the state of NV there is a law against ''flat time'' sentences. I needed to know how do I go about filing a motion without a lawyers help. What do i need to do step by step?

Re: filing a motion

The Motion that was filed in the recently-decided Haney case, which found flat-time sentences to be unlawful, was a "Motion to Correct Illegal Sentence".

The Opinion of the Nevada Supreme Court is found here:

http://www.leg.state.nv.us/scd/124NevAdvOpNo40.html

According to the Clark County website:

http://www.clarkcountycourts.us/clerk/document-prep.html

For assistance in completing criminal documents call the Criminal Records Division . . ."

The Supreme Court and/or District Court file would contain the actual Motion filed by Mr. Haney.

Your attorney can explain further.
