Road Rage - Assault & Battery

This past Monday, 5/5/08, my female cousin was in a fast food drive through in Las Vegas, Nevada and had a run in with a man and women. Because she hit her brakes abruptly the man/woman physically attacked her. They poured a drink in her car, made derogatory remarks about her ethnicity and both man/woman proceeded to punch her. She missed 3 days of work due to facial trauma. She has witnesses but only one has offered their contact info. and this person has pictures of the incident an license plate number of other party's car. Another witness gave name of the man involved in the attack but does not want to get involved and didn't leave contact info. Man/woman fled scene and police only offered to take report but to date no arrest was made and officer stated he can't do anything but take report. Law enforcement seems to be no help. What can she do. Please help.

You would be able to file a civil lawsuit against the man and woman for assault and batter for the facial injuries. If you have the license plate number of the other individual's vehicle you would be able to locate them through the Department of Motor Vehicles.

File a lawsuit and serve the woman and John Doe through DMV.
