Child custody

My son is almost 2 and his father has barely been involved in his life. The DA helped get a court order for child support. But the other day I got served with a ''Complaint to establish custody'' and a ''Joint Prelim. Injunction'' He is wanting joint custody. But on his paperwork he has claimed that we dont have a court order for child support (even though he has paid it occassionally ha) My problem here is knowing what am I suppose to file in return. I've never even seen the type of complaint he has filed. I thought they all were visitation, custody and support or paternity. He is also claiming now that he wants a paternity test even though he signed the Affadavit admitting he was the daddy 2 years ago. Any help would be great!! thanks!

It sounds as if your son's alleged father is attempting to get a Court Order to officially determine paternity. If he is able to establish conclusive paternity it would strengthen any claim he might make to establish custodial rights.

If he has filed a Motion with the Court to establish paternity and for Joint Physical Custody, you would need to file the proper oppositions and counterclaims.
