deceased parents

My niece was shot by her husband and he then killed himself and have left 2 minor children. The grandparents want to get custody of the children but so does an uncle. Also, she had left him and gotten her own apartment. There is furniture and other items in the apartment and the parents of my niece wanted to get the items out of the apartment and the uncle told them they cannot. Is this true?Also they had recently refinanced the house and she took her name off the title are the children entitled to any part of the house? Thank you.

Custody of the children would be determined by the Family Court Judge if contested. Since the couple was still married everything is still community property and debt. A probate would have to be opened and that Judge would decide who gets what property.
