Legal Question

Death - 401K and Life Insurance

23 year old son killed in car accident. Has a 4 month old and a 3 year old. Left 401K to his 24 year old sister and his life insurance to his mother. Can his girlfriend (mother of his children) sue to have these funds be given to her and the children?
