Legal Question in Civil Litigation in Nevada

Hiring and Firing

I was hired by a company and then fired one week before I was to receive my benefits. I found out that this is a very consistant pattern for this company. Do I have a legal recourse?

Re: Hiring and Firing

Unless you have a written employment contract or are in a union, Nevada is an at will state. The exception is for discrimination based on race, sex, religion or ethnicity.

Re: Hiring and Firing

Thank you for your inquiry. Nevada is what we call an "at will" employment state. This means that an employer has the right to hire or fire an employee except for legally protected reasons. Some examples;

1) If you belong to an organized union,

2) If you have a signed employment contract outlining specifice terms and conditions of your employment,

3) An employer cannot fire you based on age, gender, race, religion, or sexual orientation.

If you would like to speak to an attorney further about your situation; contact my office and we can discuss your matter further.

Regards,

Jim Herbe
