Legal Question in Employment Law in Nevada

I had been working for a company for 7 years, the company merged and told me they were downsizing and restructuring and I would be laid off in October 2012. Today, they are advertising for a job in the same facility that I worked for a job I am capable of doing and they informed us that we could be called back up to two years from termination. My question is.. Is that legal in Las Vegas,Nv to do this..

Nevada is an at-will employment state, generally meaning that an employee may be terminated for any reason or no reason at all. There are exceptions, however. For example, an employee may not be terminated based upon his or her being in a protected class (e.g., race, national origin, religion, color, sex, etc.) Also, an amployee cannot be terminated based on certain forms of retaliation connected with the exercise of certain rights (e.g., informing OSHA of unsafe working conditions, reporting violation of securities laws, etc.).
