What do I have to do to declare bankruptcy?Will I ever be able to have credit again?Will I lose my home and car? Do I need an attorney to do this?

Bankruptcy is your constitutional right which allows you to get a fresh start from oppressive debt. I would recommend getting an attorney to help you through the process as it's complicated. You simply have to show that you are no longer able to pay your debts as they become due. A bankrupcy filing will stay on your credit report for 10 years but many people have filed bankruptcy and regained their good credit. Credit is more a function of your current income and expenses and by eliminating your debt you may become more credit worthy. You do not lose your home and car when you file bankruptcy so long as you can make the payments after filing bankruptcy.
