Lease with Option to Buy

I have a lease with option to buy a house and property. I wrote my letter of intent and sent it along with my deposit check to the owner. His wife is preventing me from purchasing the house and might have listed the house to be sold. How can I stop the sale of the house? And file a lawsuite against them?

File the lease with Option to Buy with the County Recorder. This may stop any subsequent sale as the title company will require the lease option to be removed before closing escrow.

If you file a lawsuit for specific performance you can, in conjunction therewith, record a lis pendens against the property, which will keep the seller from selling it to someone else while your suit is pending (or at least prevent any such buyer from obtaining title free of your claims).
