i was stopped for 2nd dui within 2 yrs my blood ethanol finding was 0.21 g/100ml is this agrevated dui

The issue you confront is not whether or not the current offense is an "aggravated" incident. The real issue is that you were convicted of DUI two years ago. That means your current offense is a "DUI subesequent offense" and carries significantly higher penalties. Your BAC is rather high. Aggravated (for BAC) requires only .16.
