Legal Question in Family Law in New Hampshire

Restraning order

I have court coming up soon for violating a retraining order my mother had against me but she was letting me live with her willingly. She told me she dropped the restraining order. Will I go to jail? Is there any chance of that?

Re: Restraning order

There are different types of restraining orders. You do not state what type she obtained against you.

The key to this issue is that the Judge issued the order, and only the Judge can revoke, cancel, or amend the order. You Mother has no right to change anything the Judge ordered, just because she changed her mind. She has to get permission from the Judge. She also violated the order by allowing you to stay at the house.

Yes, there is always a possibility that the judge can order fines or imprisonment. However, the extent and type of order and violation need to be examined in order to better evaluate the probability of outcome.

I suggest that you should consult with a lawyer who can get a more comprehensive review of the details and advise you after hearing all the information.
