Legal Question in Landlord & Tenant Law in New Hampshire

I fell behind in rent due to having a child. Trying to be mature and responsible about the situation I looked for a new more affordable place. I got accepted into housing in November. The housing place sent my landlord a paper to fill out 4 times. We called & asked them to fill it out & they said they would. They never did & we got rejected for housing but appealed it and got the apartment. Due to them not filling out the papers the process took until the end of January for us to get the new place. Our landlords gave us a 7 day eviction (which I thought was illegal) and kept our security deposit for rent owed. Now they are suing us for one months rent. Is there any way we can fight this in court & possibly win? Also they never fixed a huge hole in the wall that cost us major money in fuel to heat our apartment, can we use this in court to help our case? We tried being responsible but they caused us to stay there a montg longer than we would have if they just filled out the paperwork.

You could make an argument that your landlord "failed to mitigate his damages." If you do some research on that, and make a clear concise presentation to the Judge, you could prevail.

It all depends on too many other factors that we can't analyze here.
