Legal Question in Real Estate Law in New Hampshire

Constant harrassment by our neighbor

My husband and I are having problems with our upstairs neighbor. In the past two months he has threatened us, stolen our mail, blasted pornographic material out his windows while there were children playing in our yard to name a few instances. We have complained numerous times to our landlord, reported him to both the police and postal inspector. Our landlord has told us in so many words if we don't like it, move.

We are expecting our first child in September, and obviously would rather not have to move, but is there any other option for us? He has even gone so far as to threaten our unborn child! Can he be forced to evict this man? We have been in contact with the last tenant, and the next door neighbors and we are not the first to have problems with him.

Do we have any legal recourse?

YOur not likely to be successful in forcing your lanlord to evict your offensive neighbor but you may be able to sue your landlord for a "constructive eviction" for permitting a breach of the covenant of "quiet enjoyment" if you move.
