Legal Question in Real Estate Law in New Hampshire

Can I try to put a lien MYSELF against a property that we hold a second mortgage of $50,000 on. They owe back taxes and there is already a first lien on it. We hold the mortgage and I was told I need to hurry up and put my lien on it for the $50,000 they owe us?

If you hold a mortgage on the property you already have a lien on it. At this point more detail would be needed to determine if you have any real security in the property. If the amount of the first mortgage and taxes exceeds the value of the house, you are under collateralized.

I suggest that you need to meet with an attorney to review the title to the property and determine if there are other ways to protect your financial position.
