Legal Question in Real Estate Law in New Hampshire

I own a vacation home and have allowed my son to stay there for over 7 years, now he will not allow any of my other children access to the property and is stating that he has established residency because he paid the taxed, has electricity, phone and cable in his name and if we attempt to go on the property he will have the police escort us off. How do I get him removed from the property?

Ultimately the answer will depend on what the actual agreement you had with your son but generally if he is a tenant you have to go through the eviction process using the sheriff to give him notice of eviction to vacate within 30 days. It is a specific form; do not try to just send him a letter. When he does not leave, you then have to bring a landlord/tenant lawsuit against him. Again the sheriff will serve him and the court will set a hearing date.

Landlord tenant law is very strict and you, as the landlord, must do everything exactly as provided in the statute. Given his attitude I would definitely get a lawyer.
