Legal Question in Real Estate Law in New Jersey

My husband and I along with our 7 month old son live in a house owned by my mother-in-law which she gained through inheritance. The house is fully paid for and my husband pays the taxes on the house and all bills like water and electric ect. He has lived here for over 10 years and I have lived here for two years. Can we be evicted from the house if she no longer wants us here or do we have some legal right to remain.

It belongs to your mother-in-law. Unless you have a written agreement, such as a lease, she may have the right to require you to vacate the house.

THIS RESPONSE IS NOT LEGAL ADVICE, SINCE I DO NOT HAVE ALL OF THE INFORMATION THAT WOULD BE REQUIRED, AND I DO NOT HAVE A REPRESENTATION AGREEMENT WITH YOU.

* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.

* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.

The house belongs to your mother-in-law. However, so long as she does not sell it, move into it, and/or you keep paying what you have agreed to as rent, she cannot make you leave. You should talk to an attorney to get a full explanation of your rights.
