Legal Question in Disability Law in New Jersey

Can I be fired while on short term disability?

I read your previous answer for someone asking you this particular question. I would like to know if one was under appeal for a denied medical claim, returned back to work, was informed that the job may be affected, had to open up a new claim, appeal and new claim were both approved. While extension was provided for std, employee receives call day later from employer stating since no fmla coverage and excessive absenteeism, was terminated over the phone. How is it possible for someone to be approved for paid diability leave, but separated from company because of unpaid leave unavailability?

Re: Can I be fired while on short term disability?

It is very hard to say from the facts as you have given them to me. Give our offices a call or e-mail me directly and I will provide you with a short questionnaire that will help us assess how much you are entitled to recover.
