Legal Question in Disability Law in New Jersey

pregnancy and work problem

I am currently 5 months pregnant, and I am currently working as both a medical assistant and fill in receptionist for a doctors office. My doctor has written me a note stating that I should currently be on desk duty, and my employer is saying that she can only gaurentee me 1 or two days a week, as opposed to my usual 5 days a week, because the majority of my week was spent as a medical assistant. Is this legal for her to take away most of my hours, or does she have to give me the same hours with lighter duty?

Re: pregnancy and work problem

Unless you have a specific union contract or some other type of employment contract that specifically covers the situation you describe, then the doctor has not done anything illegal. If your job is primarily as a medical assistant and that job requires you to be on your feet, and you are not able to do that job, then the doctor you work for does not have to bring you in on the days where she needs a medical assistant. Please contact me if you have any other questions.
